Terms of Service

These Terms of Service ("Terms") form a binding agreement between you and PKLLC LLC, a Pennsylvania limited liability company ("PKLLC," "we," "us," or "our"), governing your access to and use of the MyGuide mobile and web application and related services (collectively, the "Service"). By creating an account, downloading the App, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

MyGuide generates personalized AI audio tours for locations of your choosing. You provide a place, duration, tone, and interests; the Service produces a script, narration, transcript, and cover artwork that you can play, download for offline use, and share via links.

2. Eligibility and Accounts

You must be at least 13 years old to use the Service. You may sign in using Sign in with Apple, Sign in with Google, or an email-based sign-in option. You are responsible for maintaining the confidentiality of your sign-in credentials and for all activity that occurs under your account. Notify us promptly at help@myguide.cc if you suspect unauthorized access.

3. Subscriptions, Credits, and Payments

The Service offers free and paid plans, as well as consumable "tour credits." Paid subscriptions and credits are sold and processed through the Apple App Store and, where available, Google Play. Pricing, billing cycles, and renewals are governed by the platform you purchase through and by our subscription management provider, which manages entitlements on our behalf. We do not see or store your payment card information.

Auto-renewal. Subscriptions automatically renew at the end of each billing period unless you cancel at least 24 hours before the period ends. You can manage and cancel subscriptions in your Apple ID or Google Play account settings.

Refunds. Refund eligibility is determined by the policies of the Apple App Store or Google Play. We are unable to issue refunds directly for platform-billed purchases.

4. AI-Generated Content

Tour scripts, narration audio, and cover artwork in MyGuide are produced by third-party AI systems based on your inputs. AI output may contain inaccuracies, omissions, or fabricated facts. You should not rely on generated content as authoritative information about any place, person, business, or event. The Service is intended for entertainment and informational purposes; it is not professional, navigational, historical, legal, medical, or safety advice.

5. Acceptable Use

You agree not to:

Use the Service for any unlawful purpose or in violation of any law or regulation.
Submit prompts intended to generate content that is defamatory, harassing, hateful, sexually explicit involving minors, infringing, or otherwise prohibited.
Attempt to reverse engineer, decompile, scrape, or otherwise extract source code, models, or training data from the Service, except to the extent applicable law expressly permits.
Interfere with or disrupt the Service, our infrastructure, or other users' use of the Service.
Use the Service to develop a competing product, train a machine-learning model, or otherwise misuse generated content in violation of our or our providers' terms.
Resell, sublicense, or commercially exploit generated tours without our prior written consent.

6. Your Content and License Grants

You retain whatever rights you hold in the inputs you submit ("User Content"), such as interests, prompts, and feedback. You grant PKLLC a worldwide, royalty-free, non-exclusive license to host, store, transmit, process, modify, and display your User Content solely as necessary to operate, support, and improve the Service.

Tours generated for you are made available for your personal, non-commercial use within the Service. Subject to your compliance with these Terms, you may listen, share, and download tours for offline use. We retain ownership of the Service, the underlying software, and any content created by us.

7. Third-Party Services

The Service relies on third-party providers for AI content generation, text-to-speech, mapping and places data, identity verification, subscription management, push notifications, and hosting. Your use of features powered by these providers is subject to their terms and privacy policies, in addition to ours. We are not responsible for the acts or omissions of third-party providers. See our Privacy Policy for the categories of data shared with each.

8. Privacy

Our collection and use of personal information is described in the Privacy Policy, which is incorporated into these Terms by reference.

9. Apple App Store Terms

If you obtained the App from the Apple App Store, the following additional terms apply, and Apple is a third-party beneficiary of these Terms with the right to enforce them against you:

These Terms are between you and PKLLC, not Apple. PKLLC, not Apple, is solely responsible for the App and its content.
Your license to use the App is limited to use on Apple-branded devices that you own or control, as permitted by the Apple Media Services Terms.
Apple has no obligation to provide maintenance or support for the App.
If the App fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any). To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App.
PKLLC, not Apple, is responsible for addressing any claims by you or any third party relating to the App, including product liability claims, claims that the App fails to conform to legal requirements, and claims arising under consumer protection or similar legislation.
PKLLC, not Apple, is responsible for the investigation, defense, settlement, and discharge of any third-party intellectual property infringement claim relating to the App.
You represent that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not on any U.S. Government list of prohibited or restricted parties.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY LAW, PKLLC DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY OF AI-GENERATED CONTENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PKLLC AND ITS OFFICERS, MEMBERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUES, DATA, OR GOODWILL, ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICE. OUR AGGREGATE LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR (B) FIFTY U.S. DOLLARS (USD $50.00).

12. Indemnification

You agree to defend, indemnify, and hold harmless PKLLC and its officers, members, employees, and agents from any claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to your use of the Service, your User Content, or your violation of these Terms or applicable law.

13. Termination

You may stop using the Service and delete your account at any time by emailing help@myguide.cc. We may suspend or terminate your access to the Service at any time, with or without notice, if we believe you have violated these Terms or to protect the Service or its users. Sections that by their nature should survive termination (including ownership, disclaimers, limitations of liability, indemnification, and governing law) will survive.

14. Changes to the Service or Terms

We may modify or discontinue the Service, or any feature of it, at any time. We may also update these Terms from time to time. When we make material changes, we will revise the "Effective date" above and, where appropriate, notify you in the App. Your continued use of the Service after the new Terms take effect constitutes acceptance.

15. Governing Law and Venue

These Terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to its conflict-of-laws principles. Subject to the App Store provisions above, you and PKLLC agree that any dispute arising out of or relating to these Terms or the Service will be brought exclusively in the state or federal courts located in Pennsylvania, and each party consents to personal jurisdiction in those courts.
